Purposes of data processing
The purpose of the processing is to fulfill the public tasks assigned to us by the legislator, in particular from the Bavarian University Innovation Act.
Legal basis of the processing
Unless otherwise stated, the legal basis for the processing of your data results from Art. 4 para. 1 of the Bavarian Data Protection Act (BayDSG) in conjunction with Art. 6 para. 1 lit. e of the General Data Protection Regulation (GDPR). Accordingly, we are permitted to process the data required to fulfill a task incumbent upon us.
If you have consented to processing, the data processing is based on Art. 6 para. 1 lit. a GDPR.
Duration of storage of personal data
We do not process your personal data for longer than is necessary for the specified purpose of processing.
Many documents containing your personal data are subject to statutory retention periods under civil service, commercial, budgetary, personnel, statutory, tax or administrative law.
If there are no specific retention periods, the data is generally offered to the archive 10 or 30 years after it is created. Data worthy of archiving is transferred to the archive. Data not worthy of archiving is deleted.
Automated decision-making including profiling
Automated decisions in individual cases, including profiling, only take place if they are permitted in accordance with Art. 22 GDPR. You will be informed of this if necessary.
Recipients of personal data outside the organization
Data may be passed on within the organizational units of the controller, contractual partners, cooperation partners and service providers. If the recipients do not process the data in accordance with instructions as part of a contract for order processing, we only disclose the data if you have given your consent or if legal requirements are met, in particular Art. 5 BayDSG.
In addition to the recipients, authorities may also receive personal data as part of their investigation mandates under Union law or the law of the Member States. If necessary, your data will be transmitted to the competent supervisory and auditing authorities to exercise their respective control rights.
Transfer of data to a third country or international organization
Our service providers, cooperation partners and contractual partners come from all over the world. If we disclose personal data to them, there is either an exception in accordance with Art. 49 GDPR, the recipient or the recipient's country of domicile has an adequate level of data protection or there are guarantees in the form of the standard contractual clauses from 2021 (Annex to Commission Implementing Decision (EU) 2021/914 of June 4, 2021 on standard contractual clauses for the transfer of personal data to third countries pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council).

With regard to the processing of your personal data, you as a data subject have the following rights in accordance with Art. 15 et seq. GDPR, provided that you do not assert them abusively, manifestly unfounded or excessively:
You can request information as to whether we process your personal data. If this is the case, you have a right of access to this personal data and to further information related to the processing (Art. 15 GDPR). Please note that this right to information may be restricted or excluded in certain cases (see in particular Art. 10 BayDSG).
In the event that personal data about you is not (or no longer) accurate or incomplete, you can request that this data be corrected and, if necessary, completed (Art. 16 GDPR).
If the legal requirements are met, you can request the erasure of your personal data (Art. 17 GDPR) or the restriction of the processing of this data (Art. 18 GDPR). However, the right to erasure pursuant to Art. 17 (1) and (2) GDPR does not apply if, among other things, the processing of personal data is necessary for the performance of a task carried out in the public interest or in the exercise of official authority (Art. 17 (3) (b) GDPR). Archiving law may give priority to surrender over erasure.
If you have consented to the processing or a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR).
You have the right to complain to a supervisory authority within the meaning of Art. 51 GDPR about the processing of your personal data. The competent supervisory authority for Bavarian public bodies is the Bavarian State Commissioner for Data Protection, Wagmüllerstraße 18, 80538 Munich. In addition to the right to lodge a complaint, you can also lodge a judicial remedy.
Right to withdraw consent
If the processing is based on consent, you have the right to withdraw your consent at any time. The revocation only takes effect for the future; this means that the revocation does not affect the legality of the processing carried out on the basis of the consent until the revocation.
Right to object pursuant to Art. 21 GDPR
For reasons arising from your particular situation, you can also object to the processing of your personal data by us at any time (Art. 21 GDPR). If the legal requirements are met, we will then no longer process your personal data.
Obligation to make available
If there is a legal obligation to process data, failure to provide it constitutes a breach of employment contract, service or contractual obligations. In some cases, violations are also subject to penalties or fines.

Purposes and legal basis for the processing of personal data
The purpose of processing is to fulfill the public tasks assigned to us by law. Unless otherwise specified, the legal basis for the processing of your data is Art. 4 (1) of the Bavarian Data Protection Act (BayDSG) in conjunction with Art. 6 (1) (e) of the General Data Protection Regulation (GDPR). Accordingly, we are permitted to process the data necessary to fulfill a task incumbent upon us. If you have consented to processing, data processing is based on Article 6(1)(a) GDPR.
Recipients of personal data
If necessary, your data will be transmitted to the competent supervisory and auditing authorities for the purpose of exercising their respective control rights. In order to avert threats to information technology security, log data may be forwarded to the State Office for Information Technology Security on the basis of Art. 44 BayDiG (for more details, see "Logging").
Duration of storage of personal data
Your data will only be stored for as long as is necessary to fulfill the task, in compliance with statutory retention periods.
Your rights
Insofar as we process personal data about you, you as the data subject have the following rights:
- You can request information about whether we process your personal data. If this is the case, you have the right to obtain information about this data and other information related to the processing (Art. 15 GDPR). Please note that this right to information may be restricted or excluded in certain cases (see in particular Art. 10 of the Bavarian Data Protection Act - BayDSG).
- If incorrect personal data is processed, you have the right to have it corrected (Art. 16 GDPR).
- If the legal requirements are met, you may request the erasure or restriction of processing (Articles 17 and 18 GDPR). However, the right to erasure under Art. 17 (1) and (2) GDPR does not apply if the processing of personal data is necessary for the performance of a task carried out in the public interest or in the exercise of official authority (Art. 17 (3) (b) GDPR).
- If you have consented to the processing and the processing is based on this consent, you can revoke your consent at any time for the future. The lawfulness of the data processing carried out on the basis of the consent until revocation is not affected by this.
- You have the right to object to the processing of your data at any time for reasons arising from your particular situation (Art. 21 GDPR). If the legal requirements are met, we will no longer process your personal data.

Technical implementation
Log files
Each time our website is accessed, our system automatically collects data and information from the user's computer system.
In this context, the following data are collected:
- Anonymised IP address of the requesting computer
- Date and time of the request
- Name of the retrieved file
- Address (URL) of the website from which the file was requested
- Data volume transmitted
- Access status (file transferred, file not found, etc.)
- Description of the type of web browser and/or operating system used
The data stored are required exclusively for technical or statistical purposes; no comparison with other data or disclosure to third parties occurs, not even in part. The data are stored in our system's log files. This is not the case for the user's IP addresses or other data that make it possible to assign the data to a specific user: before data are stored, each dataset is anonymised by changing the IP address. These data are not stored together with other personal data .
To avert threats to information technology security, the State Office for Information Security may collect this data and analyze it automatically pursuant to Section 44 of the BayDiG.
SSL Encryption
This website uses SSL encryption for security reasons and to protect the transmission of confidential content, such as enquiries you send to us as the website operator. You can recognize an encrypted connection by the browser address line changing from http:// to https:// and by the lock symbol in your browser bar.
When SSL encryption is enabled, the data you transmit to us cannot be read by third parties.
